NZ writers: ebook piracy website – sample TakeDown notice

The NZSA is deeply concerned about a website, oceanofpdf.com, which makes available free copies of published books. Many Australian, English and NZ authors’ books are now or may be available for free download, particularly titles which are published internationally.

It appears that this website is hosted in the United States. If you find your book is available for free download on this site, we encourage you to take action to stop this unlawful supply of your books. Firstly, contact your publisher to see if it has already issued a takedown notice on your behalf or intends to do so.

If your publisher hasn’t already issued a takedown notice or directs you to issue one, we suggest contacting the website directly, requesting the immediate removal of your books from the site. You can contact oceansofpdf.com via the Contact Us link on the website.  If you don’t receive a response, you may also try emailing oceanofpdf.com@domainsbyproxy.com

To issue a takedown notice, you don’t need to fill out a specific form but simply need to set out who you are and what material you wish to have removed from the site.

Here is a sample takedown notice

Pursuant to 17 USC 512(c)(3)(A), this communication serves as a statement that:

I am the copyright owner of  [title of copyrighted material being infringed upon, and, if possible, additional identifying information such as ISBNs, publication dates, etc. – or, if the material is a web page, the URL]. My exclusive publisher is [insert name of publisher.]

My rights are being violated by the above material being freely available for download from your site at the following URL(s): oceanofpdf.com.

I have a good faith belief that the use of this material in such a fashion is not authorised by me, or my publisher or the law.

Under penalty of perjury in a United States court of law, I state that the information contained in this notification is accurate.

I may be contacted by the following methods (include all): [physical address, telephone number, and email address].

I hereby request that you remove or disable access to this material as it appears on your service as quickly as possible.  Thank you.
